Prostitution Isn’t A Criminal Offense In Nigeria —Court Declares

A Federal High Court sitting in Abuja today declares that sex work is not a criminal offence in Nigeria, and that it is a violation of the rights of female sex workers, FSW as enshrined under Section 37 of the Constitution for any security agent to break into their homes.

Hon. Justice Binta Murtala Nyako delivered the judgment in a case filed by Lawyers Alert on behalf of one Constance Nkwocha &15 Ors V. Min. of FCT & 5 Ors.

She finally awarded damages against the Respondents and in favour of the Applicants in the sum of N1.6 Million.

Please try to understand that the law has a condition,the truth is that prostitution is not a crime in Nigeria, but keeping a brothel is a crime in Nigeria.

So if a man agrees with a woman that he shall pay N5000 for the act (an overnight), and the two of them are caught in the night doing the act, it is not a crime.

But it shall be a crime if one habitually keeps his house as a brothel where men come and have frequent sex with women, for a fee.
